10 % Reservation can be declare for the economically weak of upper class people’s

Reference:- The central government cabinet has introduce the 124 th Constitution Amendment Bill for the extend 10% reservation to the economically weak people’s of upper class or general category. This bill are constituted for the direct recruitment in public employment. The bill will extend 10 % reservation for upper class with included economically weak communities such as Christians and Muslims etc. Who are not eligible for the current quota category.
How to identified the Beneficiaries for the quota:-
1. The annual household income should below 8 Lakh.
2. The agriculture land should below 5 acres.
3. The Residential house below 1000 sqft.
4. Residential plot below 100 yards in notified municipality.
5. Residential plot below 200 yards in non-notified municipality area.
What would be the need to success the Bill:-
If the government wants to success this bill some amendment will touch of the constitution such as;
Article-15: This article declare prohibition of discrimination of Religion, Caste, Sex and Birth of place etc.
Article-16: This article declare the equality of opportunity in public employment by the constitution.
Role of Supreme Court:-
A nine judge’s constitution bench said in Indira Sawhney case 1992 that the a backward class cannot be determined only and exclusively with reference to economic criterion. And the economic criterion may be a consideration or basis along with, and in addition to, social backwardness, but it can never be the sole criterion. The bench in its judgement declared 50% quota as the rule.
Conclusion:- This bill passed in Lok Sabha recently but it will be make an Act after to be pass in Rajya Sabha. It can be take some time to review the all issues of the reservation and another way the amendment in constitution is a long process. Therefore the success of the bill will be decide by the time.
