Spouses of H-1B visa holders, whose green card applications have reached a certain milestone, can get employment authorisation under a 2015 executive order. The Department of Homeland Security (DHS) is on track to complete an internal process within the next three months and announce the new regulation.
What is the H-4 Visa:- An H-4 visa is a visa issued by the U.S. Citizenship and Immigration Services (USCIS) to immediate family members (spouse and children under 21 years of age) of the H-1B visa holders.
Current situation of H-4 Visa:- During the tenure of former President Barack Obama, H-4 visa holders were also allowed to work in the United States. Its biggest beneficiary is Indian women, so the work permit will be affected most by the cancellation. Between May 2015 and May 2017, the US Immigration Department issued work permits to 1,26,853 H-4 visa holders. Of these 93 percent were indigenous.
Why it is being eliminated:- The Trump administration is currently reviewing the H-1B visa policy that it thinks is being misused by companies to replace American workers. The court to keep in abeyance its decision on a lawsuit filed by ‘Save Jobs USA’, representing a group of US workers who claim that their jobs have been hit by such a policy of the government that was promulgated during the previous Obama administration. It is a forward step of Trump "American first policy" to create jobs for Americans citizens.
