The need of Common Uniform Civil Code again in spotlight
? Context:- The Supreme Court of India has recently again highlight the importance of Uniform Civil Code in India. The Top court said that government has failed to bring the Uniform Civil court. The statement of the SC has put a question between the central and states governments.
About Uniform Civil Code:- Uniform civil code is the ongoing point of debate Indian mandate to replace personal laws based on the scriptures and customs of each major religious community in India with a common set of rules governing every citizen.
What the constitution says about Uniform Civil Code:- The Article 44 of the Indian constitution established a provision for Uniform Civil Code is that “there should be a Uniform Civil Code”. According to this article, “The State shall endeavor to secure for the citizens a uniform civil code throughout the territory of India”. Since the Directive Principles are only guidelines, it is not mandatory to use them.
Some reasons are following which makes Uniform Civil Code important for India-
?1. The constitution established a secular and republic nation which need a common law for all citizens rather than differentiated rules based on religious practices.
2. In the society of India the rights of women is usually very limited and poor under the religious laws so a uniform civil code is needed is gender justice.
3. Many Hindu and Muslims religious laws directly hits the rights of men and women in society like triple talaq and so on.
4. There are so many odd traditions which directly governed by religious laws. These types of odd laws overlaps the fundamental rights which guaranteed in the Indian constitution.
